MLS® VOW Terms of Use

Welcome to www.PresaleAgent.com ("the Website"). By accessing and using this Website, you ("Registrant") agree to abide by these Terms of Use. Please read these Terms carefully before proceeding.

1. Acknowledgement and Agreement

By registering for and using the MLS® VOW, the Registrant expressly acknowledges and agrees to the following:

1.1 Privacy Notice and Consent

The Registrant confirms they have received, read, and understood the British Columbia Real Estate Association's form entitled "Privacy Notice and Consent". Click Here to download the form as a PDF.

1.2 Lawful REALTOR®/Consumer or REALTOR®/Client Relationship

The Registrant acknowledges entering into a lawful REALTOR®/consumer or REALTOR®/client relationship with the MLS® VOW Participant or their corresponding brokerage, including the completion of all applicable agency, non-agency, and other disclosure obligations, and the execution of any required agreements.

1.3 Personal Use of Data

All data obtained from the MLS® VOW is intended solely for the Registrant’s personal, non-commercial use.

1.4 Bona Fide Interest

The Registrant confirms having a bona fide interest in the purchase, sale, or lease of real estate of the type being offered through the MLS® VOW.

1.5 Prohibited Activities

The Registrant agrees not to:

Copy, redistribute, or retransmit any of the MLS® VOW Data or information.
Display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any of the MLS® VOW Data to another person.
Engage in scraping activities, including "screen scraping" and "database scraping," "data mining," or any activity intended to collect, store, reorganize, summarize, or manipulate any MLS® VOW Data.

1.6 Acknowledgement of Proprietary Rights

The Registrant acknowledges the Board’s ownership of and proprietary rights in the MLS® VOW Data, including the validity of the Board's copyright.

1.7 Access for Compliance

The Registrant expressly authorizes the Board or its duly authorized representatives to access the MLS® VOW and Registrant-provided information for verifying compliance with these Terms of Use and all applicable rules, regulations, bylaws, policies, and laws.

2. Financial Obligations and Agency Agreements

2.1 These Terms of Use do not impose any financial obligation on the Registrant or create an agency agreement.

2.2 Any financial obligation or agency agreement must be:

Set forth separately from these Terms of Use.
Prominently labeled and not accepted solely by mouse click.
Confirmed by the Registrant through an additional acknowledgment of acceptance.

2.3 Prior to entering into an agency agreement, the MLS® VOW Participant must confirm whether the Registrant is party to any other agency agreements.

3. Privacy Policy

The Website has a Privacy page, found in the footer, outlining the ways in which information obtained from the Registrant will be collected, used, and disclosed. By using the Website, the Registrant consents to:

The collection and use of personal information as detailed in the Privacy Policy.
The sharing of personal information with the Board for auditing and legal purposes.

4. Record Maintenance

The MLS® VOW Participant will maintain a record of the following:

The name, email address, and (if applicable) street address of the Registrant.
The user name and password associated with the Registrant.

These records will be maintained for the duration of the password’s validity and for a minimum of 180 days after its expiration.

5. Changes to Terms of Use

The MLS® VOW Participant reserves the right to update these Terms of Use at any time. The Registrant will be notified of any material changes and will be required to agree to the updated Terms before continuing access.

CREA Terms of Use

By accessing any of the websites or mobile applications (collectively, hereinafter "website" or "websites") operated by or in connection with The Canadian Real Estate Association (CREA), including www.PresaleAgent.com, the Registrant agrees to be bound by all of the terms for use and agree these terms constitute a binding contract between the Registrant and CREA.
